POLICY ON THE PROCESSING OF PERSONAL DATA AND CONFIDENTIALITY

WHO PROVIDES PERSONAL DATA

Your personal data will be processed by the Motivation Romania Foundation, a non-profit organization that is dedicated in helping people with disabilities, located at Podişor street, no 1, Village Buda, Ilfov County, registered at Register of Associations and Foundations under no. 36/2003.

The Motivation Romania Foundation is commited to take all necessary measures to protect your personal data in compliance with all applicable national and European regulations.

DATA TO BE PROCESSED

We will process the following categories of personal data:

– identification data such as name, address, personal numeric code;

– health-related data,

– biometric data, such as photo / video;

– contact details, such as phone number, email address,

– data on professional skills

PURPOSES AND TERMS FOR THE PROCESSING OF PERSONAL DATA

The personal data of recipients who require products or services provided free of charge by the foundation, such as the name, address, serial number and ID card number, personal identification number will be collected and processed to conclude a contract or execute a contract, as well as delivery of the products.

Special data, such as health and photo / video, will be processed based on the consent of the recipient. Your consent to health data is necessary in order to benefit from mobility devices received for free of by the foundation from sponsors and charities to whom we have to demonstrate how we used these goods.

Your consent to photo-video is useful for our own advertising activities, annual reports, and it is possible to post these images in the social media or on the foundation’s website. Consent to the use of images may be withdrawn at any time.

Your contact details, such as phone number, email address, will be processed for the delivery of products or services, or to check your satisfaction in improving the quality of the foundation’s services or to inform you of the activities and actions taken by the foundation. In either of the above cases, we will previously require your consent for each of these purposes, and it may be withdrawn at any time thereafter.

Also, the personal data of Motivation Foundation (donors, participants at event etc.), such as name, surname, email and phone number, photo / video, will be processed to inform them of the activities and actions taken by sending newsletters, invitations and personalized messages. And in these cases, we will ask for your consent, and it may be withdrawn at any time thereafter.

Your personal data contained in the supporting documents will be retained by us for 10 years from the date of the end of the financial year in which they were collected. By supporting documents we mean: donation contracts and documents, accounts, social service contracts and others alike.

The photo / video will be deleted from the Foundation’s records no later than 30 days after the date of the contractual relationship, or from the date of the withdrawal of the consent, as the case may be.

Contact details (email address, phone number) will be deleted within 30 days of the date of termination of the contractual relationship or the date of the withdrawal of the consent.

Any other personal data we collect from you will be retained for as long as it is necessary to accomplish the purpose for which it was collected and will be deleted from our records within 30 days of the completion of this purpose or the withdrawal of consent, is the case.

TRANSFER OF PERSONAL DATA TO THIRD PARTIES

Personal data collected and processed by the Foundation may be transmitted to third parties if this is a legal obligation on the Foundation as a result of the request of a party or at the request of a public entity in order to carry out the specific duties assigned to him by law.

Thus, your personal data may be requested and transmitted by foundation to: County Agencies and National Employment, National Qualifications Authority, inspectors of National Agency for Fiscal Administration, police officials, courts, bailiffs, as well as any other public institution or authority whose duties include the request and obtaining of documents containing personal data from private legal entities.

Exceptionally, the personal data of beneficiaries receiving donations from the Foundation consisting in mobility devices, received by the Foundation for free from charitable, non-profit organizations based in the United States of America, may be transmitted to these organizations, only on the basis of your consent.

THE RIGHTS OF BENEFICIARIES AND SUPPORTERS

In order to respect your rights, we inform you what these are and how they can be exercised:

– the right to request the Foundation access to his own data, rectification or deletion, and the restriction of processing or the right to object to processing, as well as the right to data portability

– the right to withdraw your consent at any time as far as the data processed under consent is concerned, without affecting the legality of the processing under consent prior to its withdrawal

– the right to lodge a complaint with the National Supervisory Authority for Personal Data Processing.

In order to observe these rights, as well as any request for information, data access, rectification or deletion may be exercised in one of the following ways: a written address to the foundation, sent to the registered office or a request sent by email to the Data Processing Officer.

The Foundation will respond within the shortest time, but no more than 30 days, to any request from a target person.
